The Australian Government Parliamentary Secretary for Health and Ageing, Catherine King, today chaired the sixth meeting of the Food and Health Dialogue. The Dialogue brings together government, industry and public health groups with the aim of addressing poor dietary habits and making healthier food choices easier and more accessible for all Australians.
The Dialogue is undertaking, as its primary activity, action on food innovation. This includes a voluntary reformulation program to reduce risk-associated nutrients, including salt, sugar, saturated fat, and increase the fibre, wholegrain, fruit and vegetable content of commonly consumed foods. This activity is being supported by strategies to standardise and reduce portion sizes and improve consumer awareness of healthier food choices.
“With processed foods now forming a large part of the Australian diet, the influence of manufacturers, retailers and quick service restaurants over what we eat has never been greater,” Ms King said.
“It is important that the food industry considers health outcomes when developing and marketing its products.
“While the Dialogue has already achieved some significant outcomes, and I applaud industry for its commitment, there is still a lot of work to be done,” Ms King said. “I am determined that the Dialogue makes a real difference to the dietary intakes of Australians.”
Members of the Dialogue met in Canberra today and discussed progress against key milestones and priorities. Items included:
Engagement with the Quick Service Restaurant sector
Members welcomed Ms Tracey Monaghan, who was attending her first Dialogue meeting as the representative of the Quick Service Restaurant Forum. Participants on the Forum include McDonalds, Hungry Jacks, Subway, Yum! International (KFC and Pizza Hut), QSR Holdings (Red Rooster, Chicken Treat and Oporto) and Eagle Boys Pizza. Over the coming months Ms Monaghan will work with the Dialogue Executive to develop a strategy to engage quick service restaurants in the Dialogue’s reformulation, portion sizing and consumer messaging activities.
Point-of-sale nutrition information
Members noted the work being undertaken through the Australia New Zealand Food Regulation Ministerial Council on the provision of point-of-sale nutrition information at standard food outlets. At its meeting on 3 December 2010, the Ministerial Council agreed that Australians should have the opportunity when purchasing food from chain fast food outlets to know more about the nutritional content of those foods. The views of Dialogue members will be sought on how best to promote national consistency in the roll-out of any point-of-sale scheme.
Progress reports – Industry Roundtables
Members discussed the progress to date achieved by participants on the industry roundtables, including the agreed sodium reduction targets for simmer sauces, and sodium and saturated fat reduction targets for processed meats. A public announcement is due shortly.
More than three-quarters of the salt consumed by Australians comes from manufactured foods, with processed meats and commercially-produced condiments and sauces being among the largest contributors. Excess salt consumption has been linked with an increased risk of high blood pressure (hypertension), which is in turn a risk factor for heart and kidney disease and stroke.
Processed meats are also a key source of saturated fat, which is associated with an increased risk of coronary heart disease – the leading cause of death in Australia. According to the Australian Bureau of Statistics, in 2008 cardiovascular disease accounted for 48,000 or 34 per cent of all deaths.

Members endorsed savoury pies and large volume cheese as the next priority food categories to be targeted after soups and processed poultry. Engagement with these sectors will commence towards the end of 2011.
Research and modelling
Members noted preliminary outcomes from the review of programs that are being undertaken nationally and internationally to address poor dietary intakes. Among the programs being reviewed are programs from the United Kingdom, Canada and Europe that look at product reformulation, portion size, and consumer messaging. Findings from the review will be used to inform future Dialogue activities. The review is scheduled for completion by mid 2011.
Members also noted the dietary exposure modelling being undertaken by Food Standards Australia New Zealand. The modelling will be used to estimate the potential impacts of the Dialogue’s reformulation activities on population intakes of targeted nutrients such as sodium and saturated fat. Findings are expected in the second half of 2011.

To support the communication of Dialogue activities, members noted that efforts are underway to redesign the Food and Health Dialogue webpage. Health trust 'breached obligations' to autistic child

Mr Justice McCloskey granted a declaration that the authority failed to take steps to help the boy lead as normal a life as possible.
His parents funded support for three years until they ran out of money.
They claimed there was a breach of duty under the Children (NI) Order 1995.
The child, now aged 10, and the trust cannot be identified for legal reasons.
The court heard how no assessment of the boy's development was conducted from his birth until 2009.
No services were offered either, apart from occupational therapy, physiotherapy and speech and language therapy.
The boy's parents were informed by a social worker of the availability of respite services but declined to use them.
In 2005 they became aware of the Centre for Early Autism Treatment (CEAT) and an Applied Behavioural Analysis (ABA) it provided.
The programme was delivered by trained therapists from November 2005 to April 2009 at a total cost of £38,391.15 to the parents.
Vindication
They were said to have continued funding it because of perceived positive developments in their son.
When it ceased because they could no longer afford to pay for it, they began extensive correspondence with the trust seeking support funding for an ABA programme or comparable services aimed at maximising their son's life skills and minimising disruptive tendencies.
The trust responded by carrying out an Understanding the Needs of Children in Northern Ireland (UNOCINI) report which concluded the child could benefit from respite support services.
It noted that the parents agreed with a recommendation for 20 hours a month of direct payments for respite support.
However, the family became dissatisfied and alleged that the UNOCINI assessment was limited to such care.
They claimed it failed to address their child's needs in developing positive life skills and discouraging disruptive behaviour.
Granting a declaration in the judicial review case, Mr Justice McCloskey said the trust breached its obligations by failing to assess the needs of a child in need, and provide services designed to minimise the effect of his disabilities and the opportunity to lead as normal a life as possible.
Nicholas Quinn, of McEvoy Sheridan Solicitors, who represented the family, said the parents were satisfied with the outcome, but also disappointed that proceedings were necessary to ensure their child secured his legal entitlement.
He added: "The outcome of the proceedings represents a clear vindication of the parents' decision to bring the proceedings before the court.
"The declaration should now be considered carefully by all the health and social care trusts in Northern Ireland to ensure that children who the law recognises to be in need receive the necessary services according to their individual assessed needs."

WSJ News: White House Seeks to Boost Public Support for Health Bill

The Obama administration next week will embark on a fresh pitch for the health-care overhaul, seeking to boost public support for the law on its one-year anniversary.
But lawmakers and some policy experts say the next phase of the overhaul will be more difficult to sell. Between now and the 2012 presidential election, few consumer-oriented changes kick in. That gives the administration few tools to break a deadlock in public opinion over President Barack Obama's top domestic achievement, which he signed March 23, 2010.
A multipronged assault led by Republicans could alter the law's contours. By next year, the Supreme Court is expected to decide the constitutionality of the law's requirement that most Americans carry insurance or pay a fee.
Republicans in Congress are trying to choke off funding to implement the law, though it appears increasingly unlikely that they will be able to do so in a significant way.
Next week, nearly a half dozen cabinet secretaries will fan out across the country to promote the law's early benefits: tax credits that offset the cost of insurance for small businesses, rebate checks for seniors with high prescription costs that fall into a drug insurance coverage gap and rules that let parents keep their children on their insurance plan until their 26th birthdays.
Democrats intentionally scheduled these changes to go into effect in the early months after enactment, hoping they would help win over a skeptical public. Polling data suggest that while the early steps might have chipped away at some negative views of the law, they haven't measurably boosted its popularity.
According to a Wall Street Journal/NBC News poll from January, 39% of respondents described the law as a good idea, while another 39% described it as a bad idea. By comparison, the same poll last March showed 36% thought it was a good idea and 48% said it was a bad one.
"For a lot of people, the changes aren't personal yet," Kathleen Sebelius, secretary of health and human services, said in an interview. "We're not going to see a dramatic change in those rates until we see the new market," she said. Under the law, those changes will occur in 2014, when consumers get tax credits and new exchanges to shop for health-insurance policies.
The next phase of the law will focus on arcane policy changes designed to gradually lower the cost of health care. Among the changes are new rules that encourage health-care providers treating Medicare patients to collaborate by allowing them to pocket some of the cost savings from the increased efficiency.
"We do a pretty bad job, frankly, when people are in the hospital of making sure they don't get an infection while they are there that keeps them there longer, or that actually causes a more serious illness or death," Ms. Sebelius said. "We have delivery systems where doctors get paid for the number of tests they do, not necessarily whether or not that test is going to add to someone's health results."
To help counter Republican criticisms of the law, the Obama administration is trying to signal that states will get more flexibility to carry out the law's mandates. Last month, Mr. Obama endorsed a bipartisan Senate proposal that would move up by three years a piece of the law that allows states to design an alternate health-insurance expansion so long as it achieves the same goals as the federal law.
But Ms. Sebelius is showing no signs she will bend the rules when it comes to states' biggest concerns, such as their ability to reduce enrollment in Medicaid, the state-federal health care program for the poor. The administration hopes that by telling Americans that Republicans want to take away the law's new benefits, and go back to the old system, they will win over voters in 2012.
The Republican-led House passed a bill to repeal the entire health law earlier this year, though that measure died in the Democratic-led Senate. Now Republicans hope that the court challenges, along with a string of unintended consequences from the law, will keep voters cool on the overhaul.
"The contents of the health care bill are even worse than anyone expected," Senate Minority Leader Mitch McConnell said Thursday.

Instead, it urged further study of the issue, which suggested that the Food and Drug Administration ultimately would pursue more modest action, such as marketing restrictions aimed at reducing access for younger consumers.
The panel's long-awaited report on menthol cigarettes was met with a collective shrug from several tobacco companies, whose potent political and legal power could delay any new restrictions for years. Tobacco company stock prices rose after the committee released its report.
"The market sees little in the FDA panel findings to suggest that an outright ban is likely," said R.J. Hottovy, director of consumer research for Morningstar Inc., an investment research firm.
The advisory panel laid out a detailed critique of the special dangers posed by menthols, concluding that "removal of menthol cigarettes from the marketplace would benefit public health in the United States." Still, it declined to take the most stringent step of recommending the cigarettes be removed from the markets, leaving that decision to the FDA, which has the final say on what, if any, action is taken.
Research has found that cigarette smoking is the leading cause of preventable deaths in the U.S., claiming 443,000 lives annually and costing $100 billion for medical care and another $100 billion in lost productivity.
But there is potentially strong congressional opposition to a sweeping new regulatory push by the government, especially in the GOP-controlled House, where a majority of Republicans voted against the 2009 legislation granting the FDA authority to regulate tobacco, said Michael Siegel, a Boston University expert on the public health consequences of smoking.
And President Barack Obama may be reluctant to take on another controversial issue at a time when he is fighting to defend his signature health care overhaul and engaged in difficult negotiations over the federal deficit and other issues.
"The last thing he needs, politically, is government telling tobacco companies what to put into cigarettes," Siegel said.
In crafting the 2009 tobacco law, Congress called for a ban on candy, fruit, spices and other flavorings in cigarettes because of their potential allure for young smokers. Menthol flavoring was not banned because declaring nearly one-third of the cigarette market illegal was thought to be too disruptive and politically unpalatable.
Menthol cigarettes also have a racial dimension: They are preferred by 80 percent of black smokers, and spokesmen for several black civic groups have stepped forward to assert that a ban would unfairly target black consumers.
A ban also is opposed by convenience store operators, who rely on menthol cigarettes for approximately 4 percent of their sales, according to the National Association of Convenience Stores.
The tobacco companies are expected to pull out all the stops to block or delay FDA action.
A ban on menthol could foreshadow an effort to restrict cigarettes' content of nicotine — the addictive component of tobacco — "and that's what the industry is really afraid of," according to Robert Proctor, a professor of the history of science at Stanford University, who has testified as an expert witness in litigation against tobacco firms.
The validity of the FDA panel's conclusions already has been challenged in a suit filed by tobacco companies Lorillard Inc. and R.J. Reynolds Tobacco Co. It charges that three members of the advisory panel have conflicts of interest that taint the fairness of their deliberations.
Lorillard, Reynolds and Altria Group's Philip Morris USA all say that banning menthol would yield no public health benefit and create a black market that would fuel organized crime.
Lorillard gets about 90 percent of its revenue from a single menthol brand, Newport. Philip Morris and R.J .Reynolds have significant, but much smaller, stakes in menthol brands. Lorillard's shares ended Friday at $87.11, up 10.6 percent.
Anti-smoking groups aren't necessarily clamoring for a ban, either.
Matthew Myers, president of the Campaign for Tobacco Free Kids, said the FDA should impose changes in marketing or formulation to curb youth smoking and make it easier for African Americans to quit smoking.

New health statistics show Americans living longer

ATLANTA (Reuters) – Life expectancy in the United States has reached an all-time high, the Centers for Disease Control and Prevention said on Wednesday.
In 2009, life expectancy increased to 78.2 years, up from 78 years in 2008, it said.
For women, life expectancy was 80.6 years, up one-tenth of a year. The life expectancy for men rose to 75.7 years, an increase of two-tenths of a year.
Life expectancy for whites increased two-tenths of a year and stayed the same for blacks.
Suicide surpassed blood poisoning to become the 10th leading cause of death, the CDC said. Heart disease remained the top killer, although death rates dropped in that category and in nine of the other top 15 causes of death.
There were 2.4 million deaths in the United States in 2009, down 36,336 from the year before, the agency said.

Fears of health risks rise amid Japan crisis

Fears about health risks rose dramatically in Japan Tuesday with news of a greater radiation release and renewed warnings to remaining residents within 20 miles to stay indoors.
Japanese officials said that more radiation was released at a nuclear plant disastrously damaged by last week's tsunami. Prime Minister Naoto Kan said radiation had spread from four reactors.
"The level seems very high, and there is still a very high risk of more radiation coming out," he said.
Thyroid cancer is the most immediate risk, and the Japanese government made plans to distribute potassium iodide pills to prevent it. Worse case scenarios — lots of radioactive fallout — can lead to other cancers years later.
Even a meltdown would not necessarily mean medical doom, experts said. It depends on the amount and type of radioactive materials.
Donald Olander, professor emeritus of nuclear engineering at the University of California at Berkeley, said even the much higher levels of radiation are "not a health hazard."
The world has seen two big nuclear reactor scares — in 1986 at the Chernobyl plant in the Ukraine, and in 1979 at the Three Mile Island plant in Pennsylvania.
At Three Mile Island, even though a quarter of the reactor core melted, the steel containment structure held. The radiation released was so minuscule that it did not threaten health - the equivalent of a chest X-ray to local folks.
At Chernobyl, where there was no containment vessel, far more radioactive material was released, and of a more dangerous type than at Three Mile Island. It stayed in soil and got into plants in the Ukraine, contaminating milk and meat for decades. Thousands of children developed thyroid cancer from radiation exposure, and scientists are still working to document other possible health problems.
The lessons have not been lost on the Japanese as they grapple with the Fukushima Dai-ichi power plant, whose cooling systems failed after a power outage from the massive earthquake last week.
They have evacuated 180,000 people from areas near the troubled reactors, where relatively minimal fallout was mostly confined at first. They've told people still in the area to wear masks, which can keep radioactive particles from being inhaled.
Most importantly, they have stockpiled and are making plans to give out potassium iodide — pills that can keep radioactive iodine from being taken up by the thyroid gland and causing cancer.
"Those are all preventable cancers" if the protective pills are taken right after exposure, said University of New Mexico radiologist Dr. Fred Mettler. He led an international group that studied health effects of the Chernobyl disaster and is a U.S. representative to the United Nations on radiation safety.
At Chernobyl "they had millions of square kilometers to cover and it was all rural areas and they didn't really have anything stockpiled," he said.
The Russian reactor also lacked a containment vessel like those in Japan and the United States to prevent or minimize release of the more dangerous types of radioactive materials, Mettler said.
"Right now it's worse than Three Mile Island," Olander said, but isn't near the Chernobyl situation. Some radioactive iodine was released before the latest crisis Tuesday. Iodine is relatively short-lived, and potassium iodide pills can be used to block its uptake.
Of greater concern is the release of cesium, which officials had said was released in small amounts earlier. Cesium is absorbed throughout the body — not just by the thyroid — and stays in organs, tissue and the environment much longer, Mettler explained.
Cesium particles are relatively large and heavy, so they would not likely travel far in a plume. Much of it would drop near the reactor site, and officials hope, may be carried by winds east over the Pacific Ocean where it would fall harmlessly, Mettler said.
Any release of cesium is a concern environmentally and for health, said Jacqueline Williams, a radiation biologist and safety expert at the University of Rochester Medical Center in upstate New York.
"Prior to Chernobyl, we believed that the cesium would be diluted out, that once the cloud went through and it rained, the cesium would be washed out. What we found out was there was an accumulation of cesium in certain types of vegetation, and it accumulated rather than diluted," she said.
Animals fed on the vegetation and became contaminated, and meat and milk were affected.
"You can't be quite so blase about the fallout," Williams said.
At Three Mile Island, however, "the public health risk was close to zero because the radiation was contained within the site itself," Williams said.
Mettler agreed. The research he led in Russia documented 6,000 to 7,000 additional cases of thyroid cancer in people who were children and teens when Chernobyl occurred, "and there are questionable increases of leukemia in the cleanup workers but it's not certain."
And were there long-lasting problems from Three Mile Island?
"Not that most of the scientific community believes," Mettler said.

A university professor is giving dairy researchers a failing grade for their efforts to inform the public about the benefits of milk.
Bruce German, who is director of the Foods for Health Institute at the University of California, Davis, offered this critical evaluation while speaking at the Western Canadian Dairy Seminar in Red Deer on Wednesday.
He noted how, at the airport in Sacramento, Calif., it costs more to buy water than milk.
“What that means is, literally from a value perspective, California dairy farmers are lowering the value of water by putting it though their cows.”
The problem, said German, is that milk is being marketed as a “cheap bag of nutrients” rather than as the “greatest agricultural asset humans have ever invented.”
He described how people began using cows’ milk as a source of food some 10,000 years ago, when only those with a genetic mutation were able to digest lactose beyond infancy.
“Everyone who didn’t have that mutation is now gone from the gene pool,” said German.
“This is the strongest selective pressure on humans in recorded history. How did we manage to get to the point where milk is lower value than water, when from an evolutionary perspective, if you couldn’t digest milk lactose, you didn’t survive?”
He cited research that indicates milk helps prevent health problems like heart disease, strokes, diabetes and a variety of cancers, and provides a variety of other health benefits.
“The real value of milk, wherever you look at it around the world, you are taller, leaner, stronger, you break fewer bones at all ages and you live longer. How did we get into this position that it’s lowering the value of water?”
The process of lactation has evolved over millennia to become the optimal means by which a mother can ensure the health of her offspring, he said.
“The absolutely ingenious process of producing milk by the mother for the infant meant that milk was under the constant Darwinian selective pressure to be nourishing in all aspects.”
For instance, oligosaccharides — indigestible sugar-like molecules that are abundant in breast milk — promotes the development of beneficial bacteria in the intestines of breast-fed infants, said German. And intestinal bacteria has been found to differ between overweight and normal-weight people, diabetics and non-diabetics, people with intestinal diseases and those without, and even autistic and non-autistic individuals.
Instead of pursuing a model that emphasizes quantity — which has resulted in milk being valued at less than water — the dairy industry should emphasize its product’s quality, said German.
“The value is in the health it promotes. We need to think about processing so that it enhances those properties and dairy marketing should channel those so they go to the appropriate consumers.”
Asked about the debate concerning mandatory pasteurization of milk, German pointed out that raw milk can carry pathogens. Eliminating this danger through heat treatment is a reasonable requirement, he suggested.
“The vast majority of benefits of milk are retained in pasteurization.”

SATURDAY, March 5 (HealthDay News) -- Creating a healthy eating action plan and visualizing yourself carrying it out may help improve the way you eat, researchers suggest.
"Telling people to just change the way they eat doesn't work; we've known that for a long time," study author Barbel Knauper, an associate professor of psychology at McGill University in Montreal, said in a university news release.
"But research has shown that if people make a concrete plan about what they are going to do, they are better at acting on their intentions. What we've done that's new is to add visualization techniques to the action plan," she explained.
Her study included 177 students who were asked to set the goal of eating more fruit for a week. All of the students ate more fruit during that time. However, those who made a concrete plan, wrote it down and also visualized how they were going to carry out their plan (i.e. when, where and how they would buy, prepare and eat fruit) increased their fruit consumption twice as much as those who didn't plan or visualize.
"Athletes do lots of work mentally rehearsing their performances before competing and it's often very successful," Knauper said. "So we thought having people mentally rehearse how they were going to buy and eat their fruit should make it more likely that they would actually do it. And this is exactly what happened."
The study was published in the current issue of Psychology and Health.

President Obama sought to defuse criticism of the new health-care overhaul Monday by saying he is willing to give states an earlier opportunity to opt out of certain key requirements - but only if they can find their own ways to accomplish the law's goals.
The announcement was met with skepticism by many Republican governors who said they need to learn more about the details.
If Congress approves the plan, states could gain exemption by 2014 rather than 2017 from some central and controversial elements of the law: that most Americans carry health insurance, that many employers offer their workers coverage, and that states create insurance marketplaces to help individuals and small businesses buy health plans that meet federal rules.
To win that freedom, though, Obama reminded the governors at a White House meeting that states would have to prove to federal officials that they could still achieve the law's objectives. Specifically, they would need to demonstrate that insurance benefits would be as affordable and as comprehensive, that the same number of residents would gain coverage, and that the alternate approach would not deepen the federal deficit.
With a majority of states trying to overturn the law in the federal courts and Republican governors complaining that it gives federal regulators too heavy a hand, the president sought to move the debate onto new ground by forcing the law's critics to prove that their vision for the nation's health-care system could work.
"Many of these states contend they can do more with less if they get the flexibility to be more creative," said Drew Altman, president of the Kaiser Family Foundation, a nonpartisan health policy group. "This puts the onus back on them and calls that into question."
In taking this new tack, the White House is endorsing a proposal introduced late last year by a bipartisan trio of senators. The bill, sponsored by Sens. Ron Wyden (D-Ore.), Scott Brown (R-Mass.) and Mary Landrieu (D-La.), would accelerate a provision in the law that would allow states to ask federal health officials for "innovation waivers" starting in 2017 that would free them to devise ways to improve health care. The legislation would move up the date to 2014.
The change in timing is significant, because 2014 is when the provisions in question are to go into effect, so states could - in theory, at least - get permission early enough to avoid the requirements.
"I think that's a reasonable proposal. I support it," Obama told the governors who convened at the White House on Monday as part of the National Governors Association's semi-annual meetings. "It will give you more flexibility more quickly, while still guaranteeing the American people reform. If your state can create a plan that covers as many people as affordably and comprehensively as the Affordable Care Act does - without increasing the deficit - you can implement that plan. And we'll work with you to do it."
Although the president has endorsed the idea, Congress would still have to approve the change for states to get relief by 2014. If it did, Health and Human Services officials would then need to write rules defining specifically how states could meet criteria for a waiver.
The immediate reaction - among the governors and on Capitol Hill - was mixed.
The governors said Obama's willingness to release them earlier from some of the law's requirements was welcome. But most stopped short of embracing the idea fully, with Republicans sounding especially wary.
"A number of our fellow governors would be very interested in supporting this," said Washington Gov. Chris Gregoire (D), the NGA's chairman. "We need to talk to them to see if we can put our support behind that bill as the National Governors Association."
Kansas Gov. Sam Brownback, who opposed the health-care legislation as a member of the Senate, said Obama's proposal doesn't negate what he and other Republicans consider a fatally flawed law that they will continue to challenge in the courts. "This offers a little bit of flexibility, which I think is a positive thing," he said, "but it doesn't change the overall objection to the bill."
Other Republicans were equally cautious. "The devil's in the details," said Mississippi Gov. Haley Barbour. Sen. Orrin G. Hatch (Utah) called Obama's new timetable a "gimmick" that would not provide genuine relief.
Governors' more immediate focus was on the potentially crushing burden of rising Medicaid costs. Gregoire said the NGA would accept the president's challenge to develop a bipartisan set of recommendations that would give states more flexibility to curb Medicaid spending. But Republicans, some of whom favor converting the health insurance system for the poor from an entitlement program to a block grant, remained skeptical that Obama will authorize real changes. New Jersey Gov. Chris Christie said that on the question of Medicaid flexibility, the president "said some very nice things and he says them really nicely." But, he added, "I didn't hear any real substance" that would suggest the governors will get what they want.
The proposal to give states greater freedom from the health-care law would not specifically allow governors to deviate from Medicaid's rules for who must be covered and what medical services they must be able to receive. The proposal would, however, let states send HHS officials a combined request to alter Medicaid and their approach to health-care reform.
On Capitol Hill, a spokesman for Senate Majority Leader Harry M. Reid (D-Nev.) said: "The date was set at 2017 because that was the earliest experts thought these measures could be implemented, but we are open to hearing the administration's reasons for concluding that they can be implemented earlier."
Mike Leavitt, a former Utah governor, called Obama's announcement "sort of a hollow victory." Leavitt, who was a major proponent of state experimentation with health care when he led the Department of Health and Human Services under President George W. Bush, said that Obama was essentially telling states, " 'We'll give you permission to ask for permission sooner rather than later.' What Republicans are saying is that we don't want to have to ask for permission at all, because we can't afford to build the system that you've laid out for us."
An aide to Wyden, a liberal who also has long favored giving states more freedom to devise their own health-care approaches, said that officials from the White House and HHS have been conferring with the senator since shortly after he and Brown introduced the legislation in late November.
"It was a process of persuasion," the aide said. "They've been coming around for a while and just kind of came to fruition recently." So far, the aide added, Oregon, Vermont and Massachusetts - which developed its own health exchange before the federal law was enacted - are the only states that have said they will pursue a waiver.

McGruder and Surging K-State Top No. 7 Texas 75-70

Kansas State is surging at the right time.

Rodney McGruder scored 22 points, Jacob Pullen scored 20 and Kansas State muscled past No. 7 Texas 75-70 on Monday night, the Wildcats' fifth straight win and first on the road over a Top Ten team since 1994.
Pullen exemplified the tough, physical nature of the game, scoring 16 points in the second half despite falling hard on his right wrist as Kansas State (21-9, 9-6 Big 12) sent the Longhorns to their second straight loss and third in four games.
"Everybody wrote us off. They cast our season down the drain," Pullen said of the Wildcats' 1-4 start in the conference. "People say we're a good team again but we can't let things like that get into our locker room and we can't let down our guard. Our morale is to the sky."
Texas is heading in the opposite direction.
An 11-0 start in conference play had the Longhorns among the top contenders for a No. 1 seed in the NCAA tournament. Now they're trying to regroup and not worry about how far they may fall.
"We're better than what we're playing and that's the concern," Texas coach Rick Barnes said. "You've got to stay disciplined with what you do. Kansas State did exactly what we thought they'd do and that was try to push us out of our offense."
Texas (24-6, 12-3) met its defensive match against the Wildcats, who held the Longhorns to 34 percent shooting. Freshman Tristan Thompson scored 26 points for the Longhorns but his teammates shot just 14 of 54 from the field. Kansas State shot 50 percent two days after Texas gave up a 22-point lead and let Colorado shoot 53 percent in a road loss.
Curtis Kelly scored 15 points for Kansas State, doing much of his damage in the first half when Pullen was struggling to score. McGruder was 4 of 6 on 3-pointers.
Thompson was the only Longhorn who could match Kansas State's physical play. He grabbed 10 rebounds and had several dunks but got little help on offense. Jordan Hamilton scored 14 points on 5-of-18 shooting and was a non-factor for most of the game. J'Covan Brown scored 11 points but didn't make a field goal until hitting two long 3-pointers in the final minute.
